Description

Leicester City Council is conducting a Competitive Flexible Procedure for the collection of kerbside household waste in Leicester, management and operation of a waste transfer station, and associated services. This contract will replace the existing PFI arrangement on expiry in 2028.

The Authority's key objectives are to:

• Provide good quality, cost-efficient, value for money waste services.

• Engage, educate and support residents to minimise their waste, maximise repair, reuse, recycling and composting, and to understand how to access, and make the most of, reuse services.

• Minimise the carbon emissions and other greenhouse gases arising from the collection, treatment and disposal of waste.

• Minimise the amount of waste sent to landfill.

• Provide waste services that can evolve as necessary to support anticipated growth of household and population numbers in the City.

This will include:

• Household residual waste and dry mixed recycling (DMR) collections on an alternate weekly basis (fortnightly) instead of weekly.

• The introduction of wheeled DMR bins to replace single use bags as standard.

• Implementation of weekly food waste collections as early as possible.

• Retention of bespoke and / or more frequent arrangements for communal collection points and others as appropriate, as well as exception processes for households with specific requirements for assistance.

• Continuation of fortnightly garden waste collections from March to November.

• Continuation of clinical waste collections from households on request.

• Continuation of bulky waste collections from households on request.

Scope

The Contract shall include the following Services:

• Household Waste and Recycling Collection including:

- Residual Waste Collection Service

- Dry Mixed Recycling Collection Service

- Food Waste Collection Service

- Garden Waste Collection Service

- Bulky Waste Collection Service

- Clinical Waste Collection Service

- Other provisional items such as servicing bring banks and a commercial waste collection Service, should they become core items.

• The Contractor will procure new vehicles suitable to deliver the services on behalf of the Authority. The Authority intends to provide the capital funding for the purchase of new vehicles in line with the processes set out in the Contract and associated Schedules.

• Provision of Depot: The Authority shall provide the Contractor with a Depot and Waste Transfer Station (the Bursom site) for use on the basis of a peppercorn rent.

• Provisional items are included under this procurement, which will be subject to the dialogue component of this CPF.

These are listed in Schedule 3 Specification.

This contract does not include disposal of waste arisings, which will be subject to separate procurements.

Please note the value of the contract (Estimated) allows for indexation and includes vehicle replacement costs throughout the full 16 year term.

Description of possible extension:

8-year initial term with the option to extend for a further 8-year period in accordance with the terms of the Contract (see associated tender documents for details).

Options

The right to additional purchases while the contract is valid.

• There are a number of services which the Authority may wish to implement during the term of the Contract, known as Provisional Items Changes. These potential services comprise:

- Collection of Contract Waste from Bring Banks at a frequency to be approved by the Authority as being the most cost-efficient;

- Collection of textiles from all Customers approved to receive the service;

- Collection of household batteries from all Customers approved to receive the service;

- Collection of small WEEE from all Customers approved to receive the service;

- Collection of Household AHP Waste from all Customers approved in writing by the Authority;

- Provision of Commercial Waste Collection Services to all Commercial Waste Customers approved in writing by the Authority ;

• Due to the nature and duration of this Contract, there may be future unknown requirements whereby additional purchases may be required.

Justification for not using lots

Leicester City Council conducted extensive market engagement in 2023, 2024 and April 2025, in which suppliers provided feedback on the proposed tendering model. Feedback indicated that splitting the requirements for Collections and Disposals into separate procurements, and for the Collections element to be a single Lot, was preferred by the market. The Council considered the feedback provided and in the interest of attracting as much competition as possible for this tender, it was decided a single procurement would be used and that the other requirements currently within the existing contract would be procured separately, i.e. treatment and disposal of waste streams and management of LCC's two Household Waste Recycling Centres. Splitting the collections by smaller geographical locations is not considered to be economically or administratively advantageous.

• Stage 2 - pass/fail sections of the PSQ.

The Suppliers who successfully passed Stage 1 and Stage 2 of the assessment, and subsequently achieved a score for Stage 3, will be ranked based on that score.

The Authority intends to invite the top four (4) scoring Suppliers to participate in dialogue and submit interim tenders.

Description of risks to contract performance

The Authority has considered paragraph 5 (Materialisation of a known risk) of Schedule 8 of the PA23 and identified local government reorganisation ('LGR') as a risk that may materialise and in doing so may jeopardise the satisfactory performance of the Contract, but because of its nature, is unable to be addressed in the Contract as awarded. Where, during the term of the Contract, the relevant conditions under paragraph 5 of Schedule 8 PA23 are satisfied, the Contracting Authority may modify the Contract to remedy the risk, as a permitted contract modification under PA23.

This Tender Notice relates to the award of a public contract through a Competitive Flexible Procedure in accordance with section 20(1) and 20(2)(b) of the Procurement Act 2023 ('PA 2023').

This tender process will be formed of 4 or 5 stages:

• Stage One - Supplier Suitability and shortlisting
